These Terms of Service ("Terms") govern your access to and use of The Tail Sniffer website, mobile application, and related services (collectively, the "Service") operated by Roxstar Labs LLC ("Roxstar," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms.
If you do not agree, do not use the Service.
The Service is intended only for adults who have a legitimate aviation-related reason to use it. Access is not automatic. Roxstar may approve, deny, limit, suspend, or revoke access in its discretion.
You may be asked to provide information such as your name, email address, employer or organization, aviation role, certificate context, or intended use. You agree that any information you submit in connection with an access request or account is accurate and not misleading.
Access to the Service is conditional, revocable, and subject to ongoing compliance with these Terms and any additional access rules or policies we apply.
The Service is intended for legitimate aviation-related informational use only. It is not intended for stalking, harassment, celebrity tracking, paparazzi use, domestic surveillance, intimidation, doxxing, or any other abusive, invasive, deceptive, or unlawful purpose.
You may not, and may not permit any other person to:
The Service may display aircraft, flight, alert, and related information derived from third-party or public-source data streams. That information may be delayed, incomplete, inaccurate, unavailable, reclassified, filtered, blocked, or removed at any time.
Roxstar does not guarantee that any aircraft, route, event, alert, arrival, departure, detection, or status information will be current, accurate, complete, uninterrupted, or available at all times.
The Service is an informational tool only. It is not an air traffic service, dispatch tool, flight-following guarantee, operational-control system, separation tool, emergency-response system, safety-of-flight system, security-response system, or regulatory-compliance system.
You must not rely on the Service as your sole or primary source for any safety-critical, time-sensitive, operational, dispatch, emergency, or compliance-related decision.
Email, in-app, or other notifications may be delayed, missed, duplicated, inaccurate, or not delivered at all. Notification timing and accuracy depend on multiple systems outside Roxstar's control.
You are responsible for deciding whether and how to use any notification. Notifications are provided for convenience only and not as a guaranteed monitoring or response service.
Some aircraft, operators, or flight activity may involve heightened privacy, security, or reputational sensitivity. Roxstar may restrict, suppress, review, or remove visibility, features, organizations, or accounts where we believe doing so is appropriate to protect privacy, reduce misuse risk, comply with platform or data-source requirements, or protect the Service.
Payment, prior approval, or prior access does not create a permanent right to continued access.
You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. You must notify Roxstar promptly if you suspect unauthorized access, misuse, or compromise.
You agree to cooperate reasonably with misuse investigations, identity verification requests, and enforcement reviews.
Roxstar may suspend, restrict, or terminate your access at any time, with or without notice, if we believe:
Where misuse or risk is involved, Roxstar has no obligation to continue service, restore access, or provide a refund unless required by law.
The Service, including its software, branding, design, text, graphics, compilations, and service structure, is owned by Roxstar or its licensors and is protected by applicable intellectual property laws.
These Terms grant you only a limited, revocable, non-exclusive, non-transferable right to use the Service in accordance with these Terms.
The Service may depend on third-party infrastructure, hosting, authentication, email, analytics, mapping, or data providers. Roxstar is not responsible for third-party outages, delays, changes, restrictions, or errors.
The Service is provided "as is" and "as available." To the maximum extent permitted by law, Roxstar disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and availability.
Roxstar does not warrant that the Service will be error-free, secure, continuously available, or fit for any particular operational, commercial, or personal purpose.
To the maximum extent permitted by law, Roxstar and its affiliates, officers, members, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity, or other intangible losses, arising out of or related to the Service.
To the maximum extent permitted by law, Roxstar's total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (A) one hundred U.S. dollars ($100) or (B) the amount you paid Roxstar for the Service in the three months before the event giving rise to the claim.
You agree to defend, indemnify, and hold harmless Roxstar and its affiliates, officers, members, employees, contractors, and agents from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service must be brought exclusively in the state or federal courts located in Ohio, and you consent to personal jurisdiction and venue in those courts.
Roxstar may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time by posting an updated version with a new effective date. Your continued use of the Service after updated Terms are posted constitutes your acceptance of the revised Terms.
